Girls Sues Parents

It's all over the news the past couple of days and here are the facts. Rachel Canning, 18, a high school senior, is suing her parents to get them to pay for the rest of her high school education and college. Her high school has already said they won't kick her out. "The lawsuit asks that her parents pay the remaining tuition for her last semester at her private high school, pay her current living and transportation expenses, commit to paying her college tuition and pay her legal fees for the suit she filed against her parents." Who is paying her lawyer? The father of the friend that Rachel is currently staying with since she walked out of her family home four months ago. She left home because she didn't want to obey the rules. Apparently Rachel had a boyfriend who her parents thought was a bad influence on her and they wanted her to stop seeing him. An honor student in previous years, Rachel has been in serious trouble the past year. In October she was suspended from her expensive private school for truancy. Her boyfriend was also suspended. The parents took away her car and phone privileges. Rachel didn't like that. CSP was contacted based on Rachel's allegations of parental abuse and the investigation determined they were unfounded. Her parents are distraught. The rules they imposed on her included and 11 o'clock curfew and chores. The parents are upset with the family who took their daughter in and financed this law suit for her, and rightly so. Yesterday the judge ruled against Rachel saying, "Do we want to establish a precedent where parents live in basic fear of establishing rules of the house?" Family Division Judge Peter Bogaard asked. Rachel is seeking to remain unemancipated so her parents will be responsible for all her expenses. The judge also cited certifications submitted by the Sean and Elizabeth Canning about their daughter’s alleged history of staying out and drinking during the week. Once, he said, she was driven home by her boyfriend’s parents at 3 a.m. In addition, Bogaard said, Rachel was removed from her position as captain of the cheer leading squad and from the campus ministry. "What kind of parents would the Cannings be if they did not discipline her?" he asked. "The Cannings had the right to set up rules."

I think Rachel's parents are within their rights to refuse to pay for college. College is a privilege, not a right. College is expensive. I can see helping out a child, when you can and they deserve it, to keep loans down and allowing them more time to study. My younger daughter had no free time to work with the demands of her major. She spent almost all her time at home studying or doing assignments. Both of my girls worked hard throughout their academic careers and my husband and I wanted to help them in any way we could. But, Rachel has made some bad choices. She doesn't seem to appreciate everything she has been given. Her parents paid for her tuition at her private school and she was suspended. Her behavior at school was such that it caused her to be removed from two groups she participated in. Why should her parents pay for her last semester?  Why should they invest money in her college education? How do they know she won't drop out, skip classes and have to retake them, or fnd other ways of getting nto trouble? She broke their trust and their hearts. I knew a girl in college who dropped out after her third year to marry a guy her parents didn't approve of. Then she moved away. I heard some time later the marriage didn't work out, but she had a baby and her whole life was forever changed. Rachel sounds like spoiled brat used to getting her way. This is what she demanded and the judge refused: "Rachel Canning had sought immediate relief in the form of $650 in weekly child support and the payment of the remainder of her tuition at Morris Catholic High School, as well as attorney's fees." What nerve! I agree the parents needed to show some tough love. But their plan has been sabatoged.

I am not so much pissed at Rachel for her ungrateful behavior towards her parents, but at the Ingelsino family, who are financing her law suit. What business is this of theirs? Instead of acting as mediators and trying to help this broken family reconcile, their "well intentioned" interferance is causing more problems than ever. I think it's alienation of parental affection. They are helping her attack her parents. And where does it say she is entitled to all the things she is demanding? She is able bodied. Let her go get a job and see what it feels like to earn money the hard way instead of having it handed to her. She says her parents earn over $300,000 a year and can afford to pay for her college. Maybe they can, maybe they choose not to. It is their money to spend as they see fit. She is 18 and considered an adult. This is their family's personal business. But, instead of trying to fix the matter through reconcliation, these Ingelsino's made it easy for her to stay away from her family and not suffer any consequences for her behavior. They provide her with a roof over her head and nice home cooked meals and who knows what else. If they enjoy being so involved, let them pay for her college and expenses and wait for years or decades while she tries to pay them back. I don't think they will be so eager to do all that, do you? I think these people should be sued for helping cause possibly irreparable damage to the relationships in this family. Can't wait to see what the judge decides about college...I don't think he is going to want to set a precedent that parents have to pay for their children's education!

Long Island Power Authority aka LIPA

I have been too angry to write a blog about LIPA, but it has to be done. LIPA is the power company who serves the people of Long Island, N.Y. or rather doesn’t serve them. They charge some of the highest rates in the country to people who pay some of the highest property taxes. Every time there is a storm, the people on Long Island lose power. So when a storm of the magnitude of hurricane Sandy hit their shores, LIPA was in no way prepared to deal with the situation.

Today I heard that the Chief Operating Officer, Michael Hervey, resigned, effective at the end of this year. What a surprise! And why wait? Amid criticism from practically everyone he decided to take the cowardly way out. I wonder if he is getting a severance package paid for by the very people who are now without power? Many are STILL without power and I wouldn’t be surprised.

LIPA has never really done a good job when it comes to power outages and they have been warned to beef up their operation. The haven’t and I can only guess it’s because they want to make huge profits at the expense and neglect of their customers. LIPA is virtually a monopoly. I thought there were laws against monopolies? Anyway, the people who live on Long Island are at their mercy. I heard that LIPA would be reimbursed 75% of their additional expenses in restoring power to their customers by the Federal government AND that they intend to raise rates to make up the additional 25%. In other words, for all their incompetence and negligence they intend not to lose one thin dime! And that’s not all, LIPA bills all went out on time to it’s customers. People still without power must pay if they are on the “budget plan,” which spreads out payments over a 12 month period. If they don’t pay their bills they will get disconnect notices…when the power is restored. LIPA intends to credit them with the days they are “out of power” at the end of their 12 month period. By that time they will have raised rates and their customers will end up owing them money. Pretty neat operation they have going for them?

My cousin was one of the lucky people on Long Island. She was out power only 11 days. She had to go out and get a generator, gas cans and gas on a daily basis to run the generator. There was no gas to be had, so she had to run her generator two hours on and two hours off to conserve. She runs a day care in her home, it’s her business. She is the sole provider of her family. She also cares for her husband, who has late stage multiple sclerosis. They are on a LIPA medical priority list for power. He has medical equipment that she could not run as often as necessary. She did her best to take care of him and run her business in those 11 days. On the 11th day her husband couldn’t breathe and had to go to the hospital. She had to assume a lot of additional expenses thanks to LIPA, but she still has to pay her bill? What the hell is wrong with this picture?

A friend of mine told me about her sister, who after delivering a baby by C-Section right before the storm, had to go to a hotel to be safe, with her children and mother, while her husband watched their house get flooded. The hotel lost power and she had to change the baby with the light from her cell phone. When she went back home, her basement was totally destroyed and there was no heat for the new baby. Like my cousin, they also had to get a generator to heat their home and a lot of additional gas, because they had a new born and couldn’t allow the house to get cold. Hours on gas lines, extra expense, worry, loss of possessions, and guess what? Their LIPA bill came right on time…the FEMA check was no where to be found.

Those are just two first hand stories that I personally know about, there are tons more that are worse that I heard on the news ever since the storm hit. LIPA doesn’t inform it’s customers what is going on, no one answers their phones. I tried calling on behalf of my cousin, who had her hands full. She was really a trooper throughout and is used to dealing with life’s catastrophes, but me not so much. Just hearing how these two families suffered was bothering the hell out of me.

And guess what else? I found a facebook page that LIPA has to inform residents as to what is going on. They have a website too. Believe me when I say, they only post what they want people to know on there, not the truth. Many more were out of power than they reported. And for the life of me I don’t understand how they expect people without power to access this information? Computers need ELECTRICITY to run and recharge. I cannot tell you how disgusted I am with this company. I think they should get two or three new companies to come in and charge LIPA for all the inconvenience and expense that everyone on Long Island has had to endure because of their negligence. It may come to that too. I hear that the residents have gotten a lawyer to begin a class action lawsuit against LIPA. I can’t wait till it gets started. I hope they found someone who is ruthless and relentless. They don’t even deserve to be in business!

So if the CEO is resigning and running scared, he should be. He should be sued in civil court for his part in this chaotic fiasco that left hundreds of thousands of people in the dark literally and figuratively. It’s an outrage what this company has been allowed to do. The money they make for the service they provide is sickening!

Let’s hope justice will be swift and fair. Let’s hope the people of Long Island fight this to the bitter end and not settled out of court! Let’s hope other companies will come in and take over LIPA customers as soon as possible!

If you have a personal story about LIPA I urge you to post it here in the comments. Maybe this blog will fall into the hands of someone who can actually use it to go after LIPA? Who knows?

Diane Schuler Killed Herself and Seven Others

Two years ago, Diane Schuler made New York headlines for driving the wrong way on the Taconic State Parkway with her two children and her three nieces. She drove into a van, and in total she killed seven people: the three men in the van, herself and her daughter, and her three nieces. Her son was the only survivor. Investigation into the crash revealed that she was drunk and high on drugs. Her husband denied that she drank or took drugs numerous times. Toxicology reports do not lie.

Recent developments in the case have me peeved. Daniel Schuler, her husband is now suing the state of New York for the poorly designed highway and he is also suing his brother-in law, Warren Hance, brother of Diane Schuler, who lost his three daughters, ages 8, 7 and 5 in the crash, because he was the owner of the car. Daniel is trying to blame everyone but his wife for what happened that tragic day. Maybe he is trying to exonerate himself from blame as he pleads ignorance to the fact that his wife obviously had a substance abuse problem and he allowed her to not only drive their children around that morning, but his three nieces too. At the time of the accident, Diane was going 85 miles per hour.

On a positive note, Jackie Hance, who suffered the devastating loss of all three of her children in the crash, is now pregnant and due to give birth this fall. She had had her tubes tied after giving birth to her last baby. However, after coming back from a serious depression, she felt her daughters would want her to have another baby. I saw an interview with her not long ago. She said something striking. When you are a parent, you don’t just stop being a parent. And we never do, do we? No matter how old our children get, they will always be our babies. And the loss of a child, let alone three, to almost too great to bear and recover from. But, Jackie has come back, with the help of her friends. She is rebuilding her life and having another baby. She said she and her husband still celebrate their girls birthdays…who can imagine that and not cry, not me.

Daniel Schuler must have been aware of his wife’s drug and alcohol problem. She was drinking large quantities of vodka and smoking marijuana just before the crash, while driving. This isn’t a problem that happened overnight and he had to have seen the signs. With the amount she ingested that morning she could barely see. A 1.75 liter of vodka was found in the car at the crash site. She had reportedly drank 10 ounces while driving the van. Toxicology tests showed she smoked marijuana within an hour of the crash. Probably doing drugs and alcohol while she was driving, 6 ounces of alcohol were still not digested in her stomach and her blood alcohol was twice the legal limit. Marijuana was used up to 15 minutes to an hour before the crash. It’s absolutely sickening. It’s incomprehensible. Now this man wants to sue his brother in law, who lost three of his own children, because Diane was driving his car? Who is going to sue Daniel for allowing her to get behind the wheel of any car?
